EventTracker — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the EventTracker website at podcomet.ai, its subdomains, applications, data, APIs, and related services (together, the “Service”). The Service is operated by PodComet LLC, a Wyoming, USA limited liability company (“PodComet,” “we,” “us,” or “our”). “You” or “User” means the person or entity accessing the Service.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and acceptance
1.1. By using the Service you confirm that you are at least 18 years old (or the higher minimum age required in your country or state of residence), that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under any applicable law.
1.2. Your use of the Service may be subject to legal restrictions in your jurisdiction. You are solely responsible for ensuring that your access to and use of the Service — and your access to and use of any third-party venue, marketplace, or platform that the Service links to or displays information about — complies with all laws applicable to you. If access to information of the kind the Service provides, or to any linked venue, is restricted or prohibited where you are located, you must not use the Service for that purpose, and you bear sole responsibility for any consequences of doing so.
1.3. We do not represent that the Service is appropriate or available for use in all locations. Those who access the Service do so on their own initiative and are responsible for compliance with local law.
2. What the Service is — and what it is not
2.1. The Service is an informational, display-only aggregator. It collects publicly available data from third-party prediction-market and event-contract venues, betting exchanges, news sources, and public blockchains, normalizes and analyzes that data, and presents it — including prices and implied probabilities, volumes, liquidity, cross-venue comparisons, arbitrage and value signals, on-chain wallet activity, news matches, and proprietary research scores (such as ETScore and ETτ) — for your information.
2.2. The Service is NOT, and must not be construed as, any of the following: - a bookmaker, sportsbook, casino, gambling operator, or game of chance; - a prediction market, exchange, broker, dealer, or trading venue; - a money-services business, custodian, wallet, or fund manager; or - a provider of investment, financial, legal, tax, accounting, or betting advice.
2.3. We facilitate no transactions. We do not accept, place, route, match, or settle any wager, bet, order, or trade; we do not hold, transmit, or manage any User funds or assets; and we do not connect to any User wallet for transactional purposes. Where the Service links to a third-party venue, any account, deposit, wager, or trade you make there is solely between you and that venue, governed by that venue’s terms and the laws applicable to it.
2.4. No advice; informational only. Nothing on the Service is investment, financial, legal, tax, or betting advice, a recommendation, or a solicitation to enter into any transaction. The data and scores are provided for general informational and research purposes only. You should not rely on them as the basis for any financial or wagering decision, and you should obtain your own professional advice.
2.5. Not affiliated with the venues. Unless expressly stated, PodComet is not affiliated with, endorsed by, or sponsored by any venue, marketplace, or data source displayed on the Service. Third-party names and marks are the property of their respective owners and are used for identification only.
3. The data — accuracy, sources, and “as-is”
3.1. The information on the Service is compiled by automatically retrieving and analyzing data from third-party sources. The amount, type, and coverage of data may change over time, and we may add or remove data, sources, venues, or features at our discretion and without notice.
3.2. We do not control third-party sources and do not guarantee the accuracy, completeness, timeliness, or availability of any data. Data may be delayed, incomplete, inaccurate, or unavailable for technical, licensing, or other reasons. We make reasonable efforts to maintain and improve quality, but the Service and all data and scores are provided “AS IS” and “AS AVAILABLE.”
3.3. You use all information provided by the Service at your own risk. You are responsible for independently verifying any information before relying on it. You acknowledge the risk that information may diverge from reality, and you waive any claim against us for losses, of any kind, arising directly or indirectly from your use of, or reliance on, information provided by the Service.
4. Accounts and registration (ET& subscribers)
4.1. Some features (collectively, “ET&” or the “Subscriber Service”) require an account. When you register, you agree to provide true, accurate, and current information, to use your real identity, and to keep your information up to date.
4.2. You may hold only one account unless we agree otherwise in writing. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We never ask for your password. You may not sell, transfer, share, or sublicense your account or your access to it.
4.3. We may, at any time and at our discretion, require you to verify your identity, and we may suspend or terminate access (see Section 13) for any breach of these Terms.
5. Subscriptions, billing, and refunds (ET&)
5.1. Tiers. The Service offers a free tier and one or more paid subscription tiers (ET&). The features included in each tier, and the prices, are described at the point of purchase and may change prospectively.
5.2. Free trial. Where a free trial is offered, it lets you evaluate the Subscriber Service before being charged. Unless you cancel before the trial ends, your subscription will convert to a paid subscription and the applicable fee will be charged.
5.3. Billing and auto-renewal. Paid subscriptions are billed in advance on a recurring “Billing Cycle” (e.g., monthly or annually) through our third-party payment processor. Your subscription automatically renews at the then-current price for the same Billing Cycle unless you cancel before the renewal date. You authorize us and our payment processor to charge your payment method for each renewal.
5.4. Cancellation. You may cancel at any time through your account settings or by contacting us. Cancellation stops future renewals; it takes effect at the end of the current Billing Cycle, and you retain access until then.
5.5. Refunds. Except where a non-waivable statutory right applies (for example, certain consumer-protection or distance-selling withdrawal rights), fees already paid are non-refundable, and canceling does not entitle you to a refund of the current Billing Cycle. The free trial is the intended means of evaluating the Subscriber Service before payment. We may, at our sole discretion, grant a partial or full refund (for example, for an extended outage or a clearly erroneous charge). 5.6. Taxes. Prices are exclusive of taxes unless stated. You are responsible for any applicable taxes other than taxes on our net income.
6. Acceptable use; restrictions on EventTracker data and content
6.1. Personal and internal use only. The data, scores, analyses, and content made available through the Service are provided to you for your own personal or internal business use only, regardless of the tier you use. You may view and use them for that purpose only.
6.2. No redistribution without permission. You must not copy, reproduce, scrape, store at scale, republish, post, transmit, distribute, sell, license, sublicense, or otherwise make available to any third party any data, scores (including ETScore, ETτ, BoardScore, or any other PodComet-generated metric), analyses, or other content obtained from the Service, in whole or in part, without our prior written permission.
6.3. No automated bulk extraction. You must not use any robot, spider, scraper, headless browser, or other automated means to access, read out, index, or extract data from the Service at scale, except through an interface we expressly provide for that purpose (such as the ET& API, subject to Section 7) and within the limits we set. You must not circumvent, disable, or interfere with any access control, rate limit, tier gating, or security feature.
6.4. No competing or commercial exploitation. You must not use the Service, or any data or content obtained from it, to build, train, populate, or operate a product or service that competes with the Service, or to generate revenue from third parties using PodComet data, without a separate written agreement with us.
6.5. General prohibitions. You must not (a) use the Service unlawfully or in violation of these Terms; (b) reverse engineer, decompile, or attempt to derive source code or the underlying methodology of any PodComet score or model except to the extent this restriction is prohibited by law; (c) misrepresent your identity or your affiliation; (d) introduce malware or interfere with the Service’s operation or security; or (e) impose an unreasonable load on our infrastructure.
6.6. Enforcement. If you breach this Section, we may suspend or terminate your access without refund and pursue any remedy available to us, including recovery of confirmed losses and damages caused by unauthorized extraction or redistribution.
7. API terms (ET&)
7.1. If we provide an API, your use of it is part of the Service and subject to these Terms, plus any API-specific documentation, scopes, and rate limits we publish.
7.2. API access is granted to the subscribing account for that account’s own personal or internal use. You must keep your API keys confidential and are responsible for all use made with them.
7.3. You must not relay, submit, resell, or otherwise provide data obtained through the API to any third party, and must not use API data for commercial redistribution, without a separate written agreement with us. You must stay within the published rate limits; exceeding them, or otherwise misusing the API, is grounds for throttling, suspension, or termination without refund.
7.4. Feed Data is confidential. Where your subscription includes delivery of a data feed (including the ET& API or any bulk export), the data you receive through it (“Feed Data”) is treated as PodComet’s confidential information. You must not publish Feed Data, make it available to or accessible by any other person, or use it to build, train, populate, or substitute for a competing service, except as we expressly authorize in writing. This is in addition to, and does not limit, the restrictions in Sections 6 and 7.3.
8. Intellectual property
8.1. The Service — including its software, design, text, graphics, the selection, arrangement, normalization, and compilation of data, and all PodComet-generated analyses and scores (including ETScore and ETτ) — is owned by PodComet or its licensors and is protected by copyright, trademark, trade-secret, and other laws. “PodComet,” “EventTracker,” and associated logos and marks are our property.
8.2. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for the personal or internal use permitted in Section 6. No other right or license is granted. All rights not expressly granted are reserved.
8.3. Third-party data, names, and marks displayed on the Service remain the property of their respective owners and are presented for identification and informational purposes only.
9. Third-party venues, links, and content
9.1. The Service displays information about, and links to, third-party venues, websites, and services we do not control. We are not responsible for their content, accuracy, legality, availability, terms, or practices, and a link or display does not imply endorsement or affiliation.
9.2. If you access a third-party venue or service, you do so at your own risk and are responsible for complying with that party’s terms and with all laws applicable to you. Any dealing between you and a third party is solely between you and that party.
10. Assumption of risk
10.1. Prediction markets, event contracts, and betting carry significant financial risk, including the risk of total loss, and are restricted or prohibited in some jurisdictions. The Service is informational only and does not reduce, manage, or assume any such risk on your behalf.
10.2. You assume all risk associated with any decision you make, and any transaction you enter into with any third party, in connection with information obtained from the Service.
11. Privacy
Your use of the Service is also governed by our Privacy Policy (when published), which is incorporated into these Terms by reference and describes how we handle information collected through the Service, including registration data.
12. Disclaimers and limitation of liability
12.1. Disclaimer. To the maximum extent permitted by law, the Service and all data, scores, and content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.
12.2. Limitation of liability. To the maximum extent permitted by law, PodComet and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or wagering or trading losses, arising out of or relating to the Service or these Terms, whether or not we were advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.
12.3. Some jurisdictions do not allow certain warranty or liability exclusions; in those jurisdictions, the exclusions above apply to the fullest extent permitted by law.
13. Suspension and termination
13.1. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, for any reason, including any breach of these Terms or any suspected fraud or unlawful activity. Suspected fraud or unlawful activity may be reported to the appropriate authorities.
13.2. On termination, your right to use the Service ceases immediately, and we may deactivate or delete your account and associated data. Sections that by their nature should survive (including Sections 2, 3, 6, 8, 10, 12, 14, and 15) survive termination.
14. Indemnification
You agree to indemnify and hold harmless PodComet and its members, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, your violation of any law or third-party right, or any decision or transaction you make in connection with information obtained from the Service.
15. Governing law and dispute resolution
15.1. These Terms and the Service are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules.
15.2. The parties will first attempt to resolve any dispute informally by contacting each other. If a dispute is not resolved within sixty (60) days, it will be resolved exclusively [by binding arbitration on an individual basis / in the state and federal courts located in Wyoming], and you and PodComet waive any right to a jury trial and to participate in a class action, to the extent permitted by law. [COUNSEL: select and finalize the arbitration vs. courts mechanism, seat, rules, and the enforceability of the class-action waiver per applicable law.]
16. Communications
We may send you service-related messages (about your account, security, billing, or changes to the Service or these Terms) and, where permitted, promotional messages. You may opt out of promotional messages; you cannot opt out of essential service messages while you hold an account.
17. Changes to these Terms
We may amend these Terms at any time by posting the updated Terms on the Service and updating the “Last updated” date. Material changes will take effect on posting (or on a later stated date). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
18. General
18.1. Entire agreement. These Terms, together with the Privacy Policy and any tier- or API-specific terms we publish, are the entire agreement between you and PodComet regarding the Service and supersede any prior agreement on the subject.
18.2. No assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; any attempt to do so is void. We may assign these Terms.
18.3. Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.
18.4. No waiver. Our failure to enforce any provision is not a waiver of it.
18.5. No account resale. You agree not to sell, resell, copy, or use your account or access for any unauthorized commercial purpose.
